Managing your Tenancy

Changes to your household

You must tell us if you want a partner, friend or family member to move in with you as we need to know the details of everyone who lives in your property.

To ensure that your tenancy rights are protected it is very important to ensure that you advise us of any changes to your household. The Housing (Scotland) Act (2014) made important changes to the eligibility requirements for applicants to succeed to a tenancy. If we have not been formally advised of an occupant, they will not have the right to succeed to or be assigned the tenancy if circumstances change in the future. Some rights require six months' occupancy but succession requires 12 months & both start from the date you inform us, not the date they moved in.

This includes telling us about everyone who has previously moved in with you who you haven't already told us about, and when anyone moves into or out your home in the future at the time they do so. If you receive housing benefit it is also important to inform Argyll & Bute Council of any changes to your household.

How do I apply for a joint tenancy?

You may apply for a joint tenancy with a family member over 16, a partner or a household occupant.

Ask for my tenancy to be given to someone else (assignation)

Assignation is the term used when a tenancy passes in its entirety from one tenant to another.

This applies to both Scottish Secure Tenancy (SST) and Short SST Assignments under the Housing (Scotland) Act 2001 (the Act) and amended by the Housing (Scotland) Act 2014 (the 2014 Act).

If a tenant dies (succession)

Succession is the term used when a qualifying person takes over the tenancy following the death of the tenant. This applies to a Scottish Secure Tenancy (SST) Agreement under the Housing (Scotland) Act 2001 (the Act) and amended by the Housing (Scotland) Act 2014 (the 2014 Act). There is no right to succession in a Short SST, so this does NOT apply to Short SSTs.
