Factoring

ACHA provides a factoring and property management service to private owners throughout Argyll & Bute.

A number of owners have entered into Factoring Agreements to formalise the relationship of managing common property (eg shared roofs, foundations, chimney stacks, walls, gutters, downpipes, closes, shared entrances) which are owned and shared among all owners within a block. For these owners who are formally factored the details of your service are laid out in your Agreement – a sample of which can be found here.  Agreements are specific to your own block and title deeds. 

The Property Factors (Scotland) Act 2011 came into force on 1st October 2012 and it was necessary for ACHA to register as a property factor in relation to a number of property addresses to comply with legislative changes. The Property Factors Registration number is PF000302

As the eighth largest Housing Association in Scotland following housing stock transfer from Argyll & Bute Council, ACHA and its predecessor, the Council, have seen over 5,500 houses being sold into private ownership through the right to buy process.   The new legislation covers a number of actions carried out by ACHA and a project team is working towards delivery of the information to owners of factored property to comply with the legislation within the timescales laid down by Scottish Parliament.

The legislation covers common ground which is currently maintained by ACHA and tenemental properties where we arrange maintenance and repairs as a neighbouring owner on the basis of custom and practice where the work is required as an emergency to prevent material damage or destruction to the building.  This includes works which are carried out to a building to comply with health and safety aspects.

In due course, a Written Statement of Services will be issued to owners of factored properties, which will set out the provision of services and our compliance with the Act.

If you are a private owner of a factored property any complaints relating to the provision of ACHA’s factoring services should, in the first instance, be made through contacting a local member of staff who can assist with matters or provide you with information on our complaints process.  Should you remain unhappy with the outcome of an internal investigation you can then refer matters to the:
