Factoring
A.C.H.A. is in the process of setting up and introducing a factoring service which will be offered to private owners throughout Argyll and Bute.
At the end of July 2008 a letter was sent to all private owners of former Local Authority and ACHA houses sold under the right to buy scheme to summarise proposals and invite views and comments from owners. A copy of this letter can be viewed by clicking here.
The factoring service will be phased in gradually throughout Argyll and Bute. A representative from the Association will contact owners when their property is being introduced to the service. This will give owners the opportunity to discuss, in detail, the benefits of becoming a member of the factoring service. All owners are responsible for the maintenance and repair of their own properties. Many parts of properties can be common (eg foundations, roof, chimney stacks, mutual gable walls, gutter and downpipes, entrance door) and owners share responsibility for these parts along with other owners. Owners may also responsible for the maintenance of common areas which could include unadopted roads, footpaths, grass verges, ground etc.
Your title deeds may contain details of your responsibility for the common parts. On some occasions the deeds do not make any reference to common parts or these may be inconsistent with neighbouring properties. In terms of the Tenements (Scotland) Act 2004 you may still be responsible for them.
The Association are asking owners to join the factoring service voluntarily and a legally binding agreement will be entered into which contains information on the obligations of the Association and the owners. For full details please view the factoring agreement and Association’s factoring policy.
